At Animatic Technologies, we value the trust you place in us for your digital growth. Our policy is designed to be fair to both your investment and our team’s creative labor.

Our “Performance Failure” Guarantee

If we fail to deliver the core functionality of the project as per the signed scope within the agreed timeline (plus a 10-day grace period for technical adjustments), you are entitled to a refund of the unearned balance of your project fee.

1. Statutory Compliance

Our refund policy is governed by the following Indian legal principles:

  • Section 73 of the Indian Contract Act: Allows for compensation for loss or damage caused by a breach of contract.

  • Section 2(47) of the Consumer Protection Act, 2019: We ensure transparency to avoid “unfair trade practices” by clearly defining non-refundable services.

  • The “Reciprocal Promise” Rule (Section 51-54): Our obligation to deliver is contingent upon the client’s obligation to provide necessary assets (content, logins, feedback).

2. The "3-Stage" Refund Bylaws

We use a Milestone-Based Refund System to ensure fairness. Once a milestone is “Delivered and Accepted,” the associated fee becomes non-refundable as per the “Doctrine of Part Performance.”

3. Non-Refundable Exceptions

Under Indian Law, certain “out-of-pocket” expenses cannot be recovered once spent. These include:

  • Government Levies: GST (18%) once the invoice is generated and tax is filed.

  • Third-Party Assets: Domain registration, hosting, or premium API/Plugin costs.

  • Digital Deliverables: Once the final Branding Guide or Source Code is handed over, it is “consumed” and cannot be “returned.”

4. Client Default & "Force Majeure"

The 90-day delivery guarantee and refund eligibility are suspended under the following conditions:

  • Client Delay: If the client fails to provide content/credentials for 15 consecutive days, the project is “Paused,” and refund rights are forfeited.

  • External Factors: Delays caused by Google Merchant Center manual reviews or API downtime (factors outside Animatic’s control).

  • Jurisdiction: Any legal disputes will be subject to the exclusive jurisdiction of the courts in indore, India.
